Innovation Networks provides web hosting services. Innovation
Networks reserves the right to suspend or cancel a customer's access
to any or all services provided by Innovation Networks when
Innovation Networks decides that the account has been
inappropriately used. Your statutory rights are not affected by
these Terms and Conditions.
- We will respond to all complaints within five working days -
Although usually response is much quicker. All complaints will
remain confidential and be treated fairly - We will handle all
complaints effectively, keep you well informed of progress and
resolve your complaint within 14 days. If you are unhappy with
any service provided by Innovation Networks, please contact us
immediately either by phone or email on
support@innovation-networks.com.
- Innovation Networks will for no reason host any
pornographic, racist, or harmful material on its servers. This
also includes copyrighted works, commercial audio, video, or
music files, and any material in violation of any Federal, State
or Local regulation. If such material is discovered whilst
hosting with Innovation Networks, the service will be
immediately stopped and the respective legal parties informed.
- Innovation Networks will not host Warez material. Includes
pirated software, ROMS, emulators, phreaking, hacking, password
cracking. IP spoofing, etc., and encrypting of any of the above.
Also includes any sites which provide "links to" or "how to"
information about such material.
- Customer agrees that it shall defend, indemnify, save and
hold Innovation Networks harmless from any and all demands,
liabilities, losses, costs and claims, including reasonable
attorney's fees asserted against Innovation Networks, its
agents, its customers, officers and employees, that may arise or
result from any service provided or performed or agreed to be
performed or any product sold by customer, its agents, employees
or assigns. Customer agrees to defend, indemnify and hold
harmless Innovation Networks against liabilities arising out of;
(1) any injury to person or property caused by any products sold
or otherwise distributed in connection with proprietary servers
of Innovation Networks; (2) any material supplied by customer
infringing or allegedly infringing on the proprietary rights of
a third party; (3) copyright infringement and (4) any defective
products sold to customer from Innovation Networks.
- If the information contained within the 2nd Party's web site
can be commercially damaging for other organisations and/or
commercial businesses, Innovation Networks is to be informed
immediately and the necessary actions will be taken to
investigate and stop such offensive acts from the 2nd Party.
- Whilst every care is taken by Innovation Networks, in the
provision of our services we can not be responsible for any
damages your business may suffer through technical outages or
other occurrences. This includes loss of data resulting from
delays, non-deliveries, wrong delivery, and any and all service
interruptions caused by Innovation Networks its employees,
suppliers, customers or any third party. Innovation Networks
reserves the right to revise its policies at any time. We do
backup client data stored on our servers on a monthly basis. It
is recommended that you keep an independent backup of all data
stored on your virtual server. Data stored within Microsoft SQL
server is backed up on a daily basis. Innovation Networks
reserves the right to revise its backup and scheduling policies
at any time.
- The Data Protection Act was enacted by the Maltese
Parliament on the 14th December 2001. Ever since, Innovation
Networks has strived to fully enforce the data regulations
within the protection act on all web sites designed and hosted
on our servers. Therefore, we will not disclose any information
relating to our clients without the necessary legal
documentation allowing us to release personal information for
individual clients. We collect information about you for 2
reasons: firstly, to process your order and second, to provide
you with the best possible service.
- Accounts are to be used by the primary owner only. Account
holders are not permitted to resell, store or give away
web-hosting services from their website to other parties. Web
hosting services are defined as allowing a separate, third party
to host content on the owner's web site. Exceptions to this
include classified ads, and personal ads. Innovation Networks
reserves the right to refuse service and /or access to its
servers to anyone.
- Payment Policy - All accounts are set up on
a prepay basis if not on credit. Although Innovation Networks
reserves the right to change prices of accounts or services at
any time all pricing is guaranteed for the period of prepayment.
Payment is due each anniversary year or month following the date
the account was established. Customers will automatically be
charged again at the end of their prepay period unless closure
notification has already been given. In situations where the
card number on file is declined or the check given is invalid
Innovation Networks will immediately suspend the facility to
purchase any further services until the outstanding charge is
processed successfully. In addition, Innovation Networks
reserves the right to suspend other services until the
outstanding debt is cleared. The customer is responsible for all
money owed on the account from the time it was established to
the time that the customer sends a written cancellation request.
Bills, invoices and receipts will be sent by email unless
otherwise agreed by both parties.
- Cancellation and Refunds - Innovation
Networks reserves the right to cancel the service at any time.
In this event customers will be entitled to a pro rata refund
based upon the remaining period of service. If a customer
contravenes the Innovation Networks 'Terms and Conditions' or
the Acceptable Use Policy a refund will not be issued in the
event of a cancellation. Customers may cancel their account at
any time. If done so within 30 days of your web hosting account
being opened, your payment will be refunded within 7 days of
your cancellation and without question. Any incentives offered
to customers when opening the account will also be cancelled.
Customers may be given the option to purchase services which
were offered as start-up incentives in the result of a
cancellation.
- 30 Day Money Back Guarantee - For customers
opening their first account there is a 30 day money back
guarantee. Customers will not be entitled to this benefit if
they have previously had an account with Innovation Networks
unless the period of absence has been greater than one year. New
customers will not be entitled to a money back guarantee if any
account has previously been created at the same postal address
within the same 12 month time span. If a customer contravenes
the 'Terms and Conditions' provided by Innovation Networks or
the Acceptable Use Policy a refund will not be issued in the
event of a cancellation. Money will be refunded to the credit /
debit card used for payment or the person registered on the
check used for payment within seven working days of receiving a
request for a money back guarantee.
- Innovation Networks is a VAT registered service provider
(VAT Reg. No. MT17471127). All prices quoted are shown as
exclusive and inclusive of VAT - VAT is currently charged at 18%
for all EU countries.
